“Service” refers to the associated services provided through the Website.

“Service Provider” means Future Citizen Chain Ltd., in partnership and collaboration with FCDID Technologies Ltd. It is the entity contracted by the Republic of Montserrat responsible for administrating the Digital Residency program within Montserrat Ministry of Finance (MOF).

“Third-party Social Media Service” refers to any website or any social network website through which a User can log in or create an account to use or connect with the Service.

“Personal Data” is any information that relates to an identified or identifiable individual.

A. Personal Information

Transfer of your Personal Data

We may transfer information across borders in accordance with applicable legal requirements.

Your information, including Personal Data, is processed at the Company's operating offices and in any other places where the parties involved in the processing are located. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy, and no transfer of your personal data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information.

Updating your Personal Data

If you wish to update your personal data, you must submit a request to our support team. Updates will be processed upon verification of your identity and confirmation of the requested changes, subject to any legal or regulatory requirements.

Retention of your Personal Data

The retention of personal data depends on the purposes for which the data were collected and used (applies to all countries of jurisdictions). These personal data are retained until the users are no longer subscribed to our service(s), have no business relationship with us, until they decide to delete/deactivate their account, or until required or permitted by law or government agency due to relevant legal and regulatory obligation.

1. Users’ data during application will be retained for two years.

2. Personal data are retained for as long as the users are actively subscribed customers to the FCDID services or active digital ID holders of the Montserrat Digital Residency Program plus two (2) years.

3. For records relating to financial matters (customer transactions, bank statements, etc.), the data will be retained for seven (7) years.

4. We will retain and use your personal data to the extent necessary to comply with our legal obligations (as mandated by government agencies, for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

5. We will retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when these data are used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer time periods.

6. Access logs or history logs will be retained for two (2) years.

Deletion of your Personal Data

We will remove any information that could be used to identify you when Personal Data is no longer required for the purposes for which it was collected and used, or, where legally permitted, we will securely destroy the records.

If you wish to delete your personal data and deactivate your account, you must contact our support team and submit a request for deletion and deactivation. Upon confirmation of your request and deactivation of your account, all personal data associated with your account will be permanently deleted, subject to any legal or regulatory retention requirements.

For Digital ID holders, non-renewal of IDs after the expiration date is subject to the automatic deletion of data. The ID holders are responsible for renewing their IDs after they have expired. We will send a reminder to those who have missed the regular renewals. Non-renewal is subject to automatic data deletion a month after we send the Notice of Deletion of the Account.

However, as may be required by law, we might keep or retain certain records or information for an extended time when we have a legal obligation or lawful basis to do so, even after you cease using our service, after you have terminated the use of Our Services, or after your account has been deactivated.

Deleting your personal data may mean terminating your business relationship with us, and we may no longer offer our services to you.

Security of Your Data

We work tirelessly to improve our systems and procedures to guarantee the quality, security, integrity, and worthwhile experience when using Our Site and Our Services.

The FCDID platform is built with high-level security measures in handling and managing information. Every information sent or submitted to us through the Site undergoes a process that secures this information. We take reasonable measures to guard against loss, unauthorized access, disclosure, alteration, and destruction of the data provided through the Site. We implement administrative, technical, and physical safeguards to protect your information.

Customer Data

All customers’ data are encrypted at rest. These data can be kept in production-hardened databases or a private encrypted S3 bucket.

The user’s data will be broken down into pieces and stored in different places with certain encrypted algorithms (Merkle tree).

Access to Customer Data

Access to production systems shall only be done via AWS Workspaces virtual desktops.

No information may leave those systems unless authorized by the CEO or CTO in an ITSM ticket.

Data Back-up

All production systems and databases MUST be backed up.

Production databases MUST use the RDS automated monthly full daily backups

Production S3 buckets MUST have a replicated S3 bucket in another region that is private and secured.

Data Back-up Restoration

Once a quarter, an authorized user will restore a production backup for RDS and validate the data is consistent with production. Additionally, they will search for a recent file in S3 and validate it is in the backup bucket.

This may be automated.

Data Leakage Prevention Tools

Security team will review annually and recommend DLP tools if needed. The recommendation will be filed as an ITSM ticket and updates to policies and the virtual desktops as necessary.

Patching

All systems will be patched on a monthly basis to the LTS versions of the software running on those boxes.

This patching effort will be documented as an ITSM ticket

Password Policies

The password used to access the account MUST meet the following requirements:

  • At least one number

  • At least one symbol

  • At least one upper case letter

  • Must be at least 10 characters in length

  • May not be one of the last 12 passwords used in the system

For added high-level security, we may employ a two-factor authentication as part of the policy.

SSN Protection

There are legal restrictions on how Social Security Numbers ("SSNs") are handled under certain laws, such as in the United States of America where SSN processing is subject to its protection.

FCDID adheres to the compliance of such law while we provide you the Services. Any FCDID employee or personnel that processes or handles sensitive information, such as your SSN, shall abide by federal or state laws. Failure to comply will be dealt with accordingly.

Your Responsibility

While we strive to use commercially acceptable means to protect and secure your data, we cannot guarantee its absolute security. Likewise, transmission method over the Internet or method of electronic storage does not guarantee a 100% error-free.

Taking into account that you are first involved in submitting information and creating an account, it is highly recommended that you take extra care and precautions when handling your data and information.

To further protect your information and account, you shall also be responsible for securing any of your activities online.

FCDID accounts can only be used by the person whose name they are registered under; thus, you shall: 1) keep your FCDID login credentials and other forms of authentication in a safe environment, 2) not authorize anyone or anything to access and use your account, 3) not disclose or post your information and login credentials to anyone or any website, 4) not click on or give consent to a website asking for your credentials and information, and 5) not engage in any activity that puts your information, account, and this Site at risk of any online vulnerability and danger.
